The Orchard School respects the privacy of all who visit our website, www.orchard.org, subscribe to our newsletters, submit forms, and/or contribute to our school with money, time, or information. Through the website, we only collect personal information such as name, email address, phone number, etc., when voluntarily submitted by a visitor. Your personal information will never be sold, leased, rented, or otherwise disclosed in any manner to any entity without prior consent unless otherwise required by law or as may be necessary as part of regulatory compliance. You may also request to access, update, or delete your personal information in our records at any time by contacting us at communications@orchard.org.
The Orchard School (“Orchard School,” “we,” or “us”) has established this Privacy Policy to let you know how we collect, use, share, and protect information that we may gather from the technology, software, systems, and websites that support our operations (collectively referred to as the “Site”) or that is provided to us by you or third parties. This Privacy Policy does not apply to information that we may collect from you outside of our website, such as over the phone, by fax, or through conventional mail. This Privacy Policy does not apply to the practices of companies that Orchard School does not own or control or to people that Orchard School does not employ or manage.
 
Please be aware that The Orchard School is not responsible for the privacy policy of any other website. Some links on The Orchard School's website will take you to another party's website; we encourage you to be aware when you leave our site. This privacy policy only applies to information collected while on The Orchard School’s website. Orchard does not endorse or make any representations or warranties concerning, and will not in any way be liable for, any informational content, products, services, software, or other materials available on an external website, even if one or more pages of the external website are framed within a page of this Site. Orchard is not responsible for the privacy practices of any external website.

INFORMATION WE COLLECT
We may collect information that is reasonably capable of identifying you (“Personal Information”) such as your name, date of birth, address, email address, payment card information, and other identifiers. We collect this information from three sources:
  1. Directly from you.  We collect personal information when you visit the Site and use any of the services provided via the Site.  For example, when you request information or services, interact with us, contact us, or make other inquiries on the Site, we collect personal information. 
When you donate to the various programs through the Site using payment cards, the Site collects the payment card information – including, but not limited to credit card number, expiration date, and billing address – and transmits that information to our trusted payment processor.
  1. Automatically as you navigate our Site. We may collect certain information from your activity using cookies or other tracking technologies like tags, pixels, clear pixels, gifs, bugs, beacons, and other similar technologies, some of which may enable us or our service providers to identify you and collect information about you across devices and Site.
 
Usage Information.  We may collect additional information from you that may not by itself reasonably identify you as the source (collectively, “Usage Information”).  Usage Information may include “click stream” activity, such as when you click on a banner advertisement; the type of internet browser and computer operating system you are using; the location from which you are accessing the Site; the URL of the website from which you linked to the Site; the areas of the Site you visited; and the actions you performed on the Site.  We will take reasonable measures to ensure that the Usage Information we collect is not personally identifiable and may not later be easily used to identify you except in the case of fraud checks or as otherwise required by applicable law. Orchard will own all discoveries, ideas, improvements, products, services, software, data, intellectual property, and other rights arising from and/or related to Orchard’s use, analysis, research, and/or development of the Usage Information, and may sell and/or license Usage Information at its discretion.
  1. From our trusted business partners. The information they collect may be associated with your personal information or they may collect information, including personal information such as name, address, email address, and financial information when you donate, about your online activities over time and across different websites and other online services. They may use this information to provide you with interest-based (behavioral) advertising or other targeted content.
COOKIES

USING YOUR INFORMATION

Service Providers: We may employ third-party service providers to perform functions on our behalf.  They may have access to personal information needed to perform their functions but may not use it for other purposes.  We use a third-party payment service to process purchases made through the Site.  In these cases, your information may be collected by this third party and not by us and will be subject to the third party’s privacy policy, rather than this Privacy Policy. We have no control over and are not responsible for, this third party’s use or disclosure of your information.
  2. Legal Obligations: From time to time, we may be required to share personal information in response to a valid court order, subpoena, government investigation, or as otherwise required by law.  We also reserve the right to report to law enforcement agencies any activities that we, in good faith, believe to be unlawful or related to an alleged unlawful activity.

Protection of Orchard and Others: We may release your information when we believe release is appropriate to (i) comply with the law or any rule, regulation, government or court order; (ii) enforce or apply our Terms of Use and other agreements; or (iii) protect the rights, property, or safety of Orchard, our affiliated companies, our users, or others.  However, this does not include selling, sharing, or otherwise disclosing personally identifiable information from customers for commercial purposes in violation of the terms set forth in this Privacy Policy.
  4. Sale or Acquisition: If we become involved in a transaction involving the sale of our assets, such as a merger or acquisition, or if Orchard is transferred to another company, we may disclose and/or transfer your information as part of the transaction.  If the surviving entity is not Orchard, your information may be used pursuant to the surviving entity’s privacy policies, which may be different from this Privacy Policy.
 
Orchard School collects personal information made available to Orchard School by contracting educational agencies and institutions, such as student names, student identification numbers, e-mail addresses, GPA, grades, courses taken, standardized test scores, and related information.
 
Any personal information collected by The Orchard School from prospective families, current families, and alumni is stored in a confidential database. Access to this information is restricted to authorized staff of the School. The Orchard School is committed to maintaining the confidentiality, privacy, and security of the personal information it collects. OUR COMMITMENT TO DATA SECURITY
We use industry-standard practices designed to safeguard the confidentiality of your personal information and personal information about your children. To prevent unauthorized access, maintain data accuracy, and ensure the correct use of such information, we have put in place physical, electronic, and managerial procedures designed to safeguard and secure the personal information we collect. We also use 128-bit Secure Sockets Layer (SSL) protocol to protect information when routed between your browser and Orchard School’s servers and when in route between Orchard School’s servers and another other browser or server.
 
Personal information residing on Orchard School’s servers is password-protected, and access is provided only to those employees of Orchard School who require such access to administer and maintain our Site or to provide requested customer support to users of the Site. Each Orchard School employee who has access to the data residing on our servers has agreed in writing to respect the privacy of all such personal information.

YOUR PRIVACY RIGHTS & CHOICES
We offer you the following choices about what information we collect from you and how we communicate with you:
 
  1. Opt-out of Communications: 
If you no longer want to receive certain communications from us via email or text message, simply click the “unsubscribe” link in the email or reply STOP (or as otherwise instructed) to the text message. Please note that you cannot unsubscribe from service-related correspondence from us, such as messages relating to your donations and/or transactions.
  1. Cookies:
You have the ability to accept or decline cookies. Most web browsers automatically accept cookies, but you can usually modify your browser setting to decline cookies if you prefer. If, however, you choose to decline cookies, you may not be able to fully experience the interactive features of our Site or have some of our services on the Site function properly.
  1. Web Analytics:
You may opt-out of the aggregation and analysis of data collected about you on the Site by our web analytics vendor by visiting https://tools.google.com/dlpage/gaoptout and downloading and installing the Google Analytics Opt-out Browser Add-on.
  1. Do Not Track:
We may automatically collect cookies and other information when you use the Site. Due to this automatic collection, we do not currently honor browser-based “do not track” requests. We currently participate in third-party ad networks and use third-party cookies as discussed above to track your visits across the Site.

MODIFYING, CORRECTING, OR DELETING YOUR INFORMATION
You may update, otherwise modify or delete any personal information you previously provided on the Site by logging onto the Site and accessing either your user profile or an application containing the information you want to change. Please note that if you delete information, it will no longer be available on the Site.
 
We may reject requests that are unreasonable or not required by law, including those that would be extremely impractical, could require disproportionate technical effort, or could expose us to operational risks such as fraud. We may retain information as required or permitted by applicable laws and regulations, including to honor your choices, for our billing or records purposes, and to fulfill the purposes described in this Privacy Policy. Text, images, videos, documents, and any other electronic materials and media available on The Orchard School’s website are available as a resource to the public and are the sole property of The Orchard School and are protected by copyright. The reproduction, redistribution, and/or exploitation of any of these materials is prohibited without express, written consent from The Orchard School.
 
All users agree that all content and data, particularly any telephone numbers, email addresses, postal addresses, or other information contained in the directories of the website, is restricted to the personal use of authorized visitors only. The commercial use of information on this website is strictly prohibited. Users agree not to copy, post, email, or otherwise transmit any unsolicited or unauthorized advertising or promotional materials.
 
The Orchard School reserves the right to limit, restrict, or terminate the use of the website by any individual person or party with or without notice at any time.
 
CHANGES TO THE PRIVACY POLICY
We will occasionally amend this Privacy Policy to reflect company and customer feedback. We reserve the right to change, modify, add, or remove portions of this Privacy Policy at any time. If Orchard School materially changes its use of your or your children’s personal information, we will announce such a change on our Site and will also note it in this Privacy Policy, and we will provide you with an opportunity to opt-out of such new or different use. The effective date of this Privacy Policy is documented at the beginning of the Privacy Policy. You are responsible for periodically reviewing the Site and this Privacy Policy to check for any updates or changes.

ENFORCEMENT
Orchard School is committed to ensuring the integrity and security of user information. Orchard School reserves the right to pursue all legal remedies available to it in the event that its security measures and/or this Privacy Policy is breached, including but not limited to pursuit of all criminal and civil law enforcement proceedings available as of the occurrence of any breach.
